Artwork & Intellectual Property Policy
Effective [EFFECTIVE DATE — TBD] · Plain-English summary for customers in Texas
Only send art you own or have permission to use. Here’s what that means and what happens if there’s a problem.
Your promise about artwork
When you upload or send artwork, logos, names, photos, likenesses, or text, or ask us to print them, you warrant (promise) that:
- you own them, or you have written permission from the owner to reproduce them on apparel in the quantities you’re ordering;
- you have permission from any person whose name, image or likeness appears;
- printing them doesn’t infringe any copyright, trademark, right of publicity or other right, and isn’t unlawful.
You agree to indemnify and hold harmless [TBD LLC NAME], Rally Shirt Co. and our partner print shops from any claims, losses, damages and reasonable legal fees arising from content you provided.
School, team and licensed logos
Many school district, college, and professional team names and logos are trademarks with licensing rules. If you’re ordering for a school, booster club or league, you’re responsible for having that group’s approval to use its name and marks. We may ask for written proof and may refuse the job without it.
What we won’t print
We may refuse any job, including ones with unauthorized trademarks or logos, copyrighted characters, celebrity likenesses, hateful or harassing content, obscene content, or anything illegal.
Who owns what
- You keep ownership of the artwork you provide. You give us and our partner print shops permission to use it only to quote, proof, produce and deliver your order (and reorders you request).
- Design work we or our designers create for you (cleanups, layouts, separations) may be used by you for your order. Files like screens and separations remain the property of whoever made them unless we agree otherwise in writing.
- We won’t use your art in our marketing without your permission.
Copyright or trademark complaints (DMCA / takedown)
If you believe something we printed or display infringes your rights, send a notice to our designated contact:
Please include: (1) your contact information; (2) a description of the work or mark you believe is infringed; (3) where the material appears (a link, order description, or photo); (4) a statement that you have a good-faith belief the use isn’t authorized by the owner, its agent, or the law; (5) a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner; and (6) your physical or electronic signature.
When we receive a valid notice, we’ll remove or stop using the material and stop production of affected orders while we look into it. If you think your material was removed by mistake, you can send us a counter-notice with similar information. We may refuse future orders from repeat infringers, and we may report suspected infringement to the rights owner.
Indemnity
The defense and indemnification terms in Section 12 of our Terms of Service apply to all artwork and content you provide.
